HFO Services Ltd
and the Truth About Your Debt

They will ask you for your cellphone number if you have one and most
of us have one. But it is important that you do not tell them. Because
if they have it they will be able to bother you at home and at work
round the clock. They will continue to do this even when you tell them
not to, therefore you must tell them in writing, and send the letter
by registered post or recorded delivery so that you get a signature
as proof of safe delivery (although so many of these people operate
from a PO box number so a signature is impossible to obtain). Some DCAs
will contact the people next door to ask them about your debt. Some
may tell your kids that you are a bad parent because you can't pay your
bills or threaten to do this, wanting to scare you and thus widen their
profit margin. All these debt collecting companies are purely profit
driven and so their individual sales people know well that they have
to hit their sales targets. All these activities are illegal, yet the
law seems to be indifferent for some reason. Dealing with the demands
of HFO Services Ltd can be very stressful.
Some debt collection firms are worse than the rest. Some debt collectors
routinely deal in sending off thousands of tentative letters about hypothetical
debt telling people that they owe some money when they owe nothing at
all. This tactic seems to work for the debt collecting agencies because
they are aware that a small proportion of frightened people always capitulate
when bullied although they know that they have bo debts whatsoever.
Some of these debt collecting companies compile lists of debtor accounts
which are over six years old and try to make money from them. But this
is totally illegal. They are classified as Statute Barred, they are
out of date and they cannot be legally enforced.
It is an option to call into question the validity of the money owed
by making a Subject Access Request as a foil to HFO Services Ltd. The
owner of the debt (the bank or the DCA) must send you a true copy of
your original credit agreement if the agreement was made before April
6th 2007. When they fail to do this they are breaking the law, and the
alleged debt is in dispute. As long as this situation exists they must
not ask you for any money (if they do so they are breaking the law once
again) and they must not sell it on to another agency (which many do
nevertheless at this stage). As long as the alleged debt is in dispute
it is said to be unenforceable, even by a court. There's a series of
pre-written letters available for use. Or you can get a solicitor to
help you, due to the complexity of the law at certain points. There
are also paralegal firms professing their services in this area.
Many people like yourself have noticed with shock that these debt
collectors always insist on talking to you on the phone. For some reason
they always choose to call you on the phone rather than communicate
in writing. Well the reason for this is that they wouldn't be able to
threaten you on paper for the reason that they would not wish to lie
in a verifiable form such as a letter.
So ask HFO Services
Ltd for a copy of the original contract when you took out your loan
or credit card.
Even better, start
an unenforceable
credit agreement application enquiry. It costs nothing to do this
and you are protected by the consumer credit laws. Click
here for the unenforceable contract application form.
To find out if you
qualify for an IVA or can benefit from a debt management programme,
try the IVA
Test. It's free to apply, and again you are protected by the consumer
laws regarding debt management at all stages. Click
here to go to the application form.
